Avoid mud on the road

Mud on the road regularly generates tensions with neighbours and the locals. It is important not to take this lightly. Mud on the road is not only disagreeable, it can also lead to dangerous situations. If an accident takes place and there is a causal relationship between the mud spot - caused by an excavation worker - and the accident, a judge can hold the worker liable.

What to do with mud on the road?

If, as a result of works, mud is left behind on the public road, it is recommended to:

  • put up signs warning the other road users;

  • have the public road cleaned up as quickly as possible;

  • remove the signs only after that.

Is it a busy road, or is there really a lot of mud on the road surface? Then be sure to notify the police. They will mark out the danger and possibly also divert traffic.

Note: you are still obliged to clean up the road surface - and you remain liable in case of a possible accident!

What does the legislation say?

Article 7.1. of the Traffic Law regulates everything related to fouling of the road, because this is - after all - an ordinary traffic violation. Naturally, this article must be applied in a reasonable manner. For example, there is no violation if it appears that a contractor at regular intervals took the necessary measures to remove the dirt that has fallen on the roadway.
